Terms of Service

These Terms of Service ("Terms") constitute a binding agreement between you ("Customer," "you," or "your") and Cold Stone Creamery of Reno, LLC ("Company," "we," "us," or "our"), governing your access to and use of the CreameryOps multi-franchise management platform (the "Service").

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

CreameryOps is a multi-franchise management platform that provides operational tools for franchise owners and authorized administrators. The Service includes, but is not limited to:

  • Sales Analytics — Point-of-sale data aggregation, daily and period reporting, and trend analysis
  • Labor Analytics — Labor cost tracking, scheduling efficiency metrics, and overtime monitoring
  • Financial Dashboards — Revenue summaries, cost-of-goods analysis, and financial performance reporting
  • Applicant Tracking System (ATS) — Recruitment pipeline management and candidate tracking
  • Employee Scheduling — Shift planning, availability management, and schedule publication
  • Employee Onboarding — Digital onboarding workflows and document management
  • Inventory Management — Par level tracking, waste monitoring, and order optimization

The Service is delivered as a cloud-based software-as-a-service platform. Features available to your account depend on your subscription tier and feature enablement configuration.

3. Account Registration and Security

3.1 Account Creation

Access to the Service requires authentication. You must provide accurate, complete registration information. Each user account is personal and non-transferable.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately at [email protected] if you become aware of any unauthorized access

3.3 User Roles

The Service supports multiple user roles within your franchise organization, including Owner, Admin, Manager, and Staff. You are responsible for managing user roles and access within your organization.

4. Subscription and Billing

Access to the Service requires an active subscription. All payments are processed through Stripe, Inc. Subscriptions are billed on a monthly or annual basis. We may adjust pricing with at least 30 days' written notice. Accounts with overdue payments may have access suspended until the balance is resolved.

5. Data Ownership

You retain full ownership of all data you or your authorized users submit, upload, or generate through the Service ("Customer Data"). You grant us a limited, non-exclusive license to use, process, and store your Customer Data solely for the purpose of providing and improving the Service.

You may export your Customer Data at any time through the Service's built-in export tools in standard formats including CSV and JSON.

6. Multi-Tenant Data Isolation

The Service operates on a multi-tenant architecture. We guarantee that your Customer Data is logically isolated from all other customers' data. No other customer can access, view, or query your data. All queries and reports are filtered by your franchisee identifier.

7. Acceptable Use

When using the Service, you agree not to access data beyond those authorized for your account, share account credentials, use the Service for any unlawful purpose, attempt to interfere with or disrupt the Service, or reverse engineer the Service.

8. Service Availability

We target 99.5% monthly uptime for the Service.

9. Termination

You may terminate your subscription at any time by providing written notice to [email protected]. Upon termination, you will have a 30-day window to export your Customer Data. After the 30-day window, we will delete your Customer Data in accordance with our data retention policies.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada. Any legal action shall be brought exclusively in the state or federal courts located in Washoe County, Nevada.
